State Representative Tanner Magee wanted a "Vax-a-Million" lottery program in Louisiana.
We think his actions (and lack thereof) during this past session show his true colors.
Why do we bring this up now?
Representative Magee is vying for a judgeship in the First Circuit Court of Appeals race on November 8th. As the House Speaker Pro Tempore, Magee had endless opportunities to advocate for the unmasking of children and for protecting the Louisiana business owner and employee from economy-wrecking vaccine mandates, but never used the position to effectively advocate on their behalf and never introduced legislation to prohibit this form of incredible government overreach. While we would love to see him depart the legislature because of his lack of effective leadership on issues of health freedom, we also understand the importance of the judiciary.
The role of the judiciary during a public health emergency cannot be overstated - various rulings over the last two years have literally determined the livelihoods of our fellow citizens. Some judgeships are appointments, others are elected positions. All matter, but only WE have control over the elected positions. Moral courage, integrity, wisdom, and a clear understanding of the law and our Constitution is absolutely vital to be given the honor to sit in judgement over our peers.
The fact that Magee introduced House Resolution 172, which would “urge and request the governor to consider instituting in this state a program to incentivize COVID-19 vaccine take-up which is modeled on the Vax-a-Million lottery program of the State of Ohio,” just days before the end of the 2021 Regular Legislative Session, causes considerable concern.
When the resolution was introduced, there were no licensed, or FDA approved, covid vaccines on the market, meaning the lottery program in Ohio that Magee referenced in his legislation was incentivizing the uptake of an experimental drug - a human rights violation.
As I explained in Purveyors of Misinformation: Louisiana Department of Health, an Emergency Use Authorized (EUA) drug is still an experimental drug by the FDA’s own standards. As stated in the original FDA Briefing Document for Pfizer:
“In the event an EUA is issued for this product, it would still be considered unapproved and it would be under further investigation (under an Investigational New Drug Application) until it is licensed under a Biologics License Application (BLA).”
On its website, the FDA defines investigational this way:
“An investigational drug can also be called an experimental drug and is being studied to see if your disease or medical condition improves while taking it.”
As Nuremberg states:
The voluntary consent of the human subject is absolutely essential.
This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved, as to enable him to make an understanding and enlightened decision.
When we made our members aware of Magee’s resolution, his constituents bombarded him with phone calls and emails. Thankfully, he relented and pulled the resolution on June 8, 2021.
But when Governor Edwards instituted a vaccine lottery system less than two weeks later on June 17, 2021 - the day before the CDC’s ACIP committee met to discuss myocarditis concerns in teens - there was no challenge from Magee.
It looks like JBE needed a lackey in the legislature to make it look like it wasn’t his idea. Enter Magee.
Millions in federal tax dollars were used to entice young and old alike to get an experimental covid vaccine in a lottery system. Several minors won.
The ethical issues of this type of scheme are mind-boggling, yet Magee was silent.
As you consider the candidates for judge in the First Circuit Court of Appeals race, keep in mind Magee’s lack of advocacy on issues of health freedom and his support of an unethical and wasteful “Vax-a-Million” scheme.
