A Right to Refuse an EUA or PREP Act Countermeasure: Why is This Important?
HB866 by Rep Beryl Amedee is one of the most important pieces of legislation moving through the Louisiana Legislature.
HB866 by Rep Beryl Amedee reads:
No business, employer, person, political subdivision, public official, healthcare provider, or any other entity shall do any of the following based on a person's refusal to receive any biologic, vaccine, drug, pharmaceutical, medical device, gene therapy, DNA-based product, or RNA-based product which has been Authorized for Emergency Use or is a declared a countermeasure through the Public Readiness and Emergency Preparedness Act for reasons of conscience, including but not limited to religious convictions:
(1) Deny or terminate employment.
(2) Deny a service, including a public service, to the individual.
(3) Deny access to commerce.
(4) Segregate the person.
(5) Penalize the person or use financial coercion.
(6) Discriminate against a person, including any imposition, requirement, or burden.
“It will never be mandated.”
That’s what they said. They said it for months.
And then they mandated it. 🤨
Legally, every American has the right to refuse a medical intervention Authorized for Emergency Use (EUA). It clearly states in the federal law that establishes the authority of the Secretary of Health and Human Services to issue EUAs for “a drug, device, or biological product intended for use in an actual or potential emergency,” that recipients be made aware “of the option to accept or refuse administration of the product,” and what may result, medically, if they decline.
Americans were never adequately informed of this or why it is a necessary aspect of the law.
Why is a right to refuse necessary for an EUA medical intervention?
Quite simply: EUAs are experimental in one of two ways.
Unlicensed and experimental
Licensed (FDA approved) but experimental for the purpose intended.
Medical ethics and human rights demand that human test subjects be provided with voluntary informed consent, free from “any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion,” even in the midst of a public health emergency.
Especially in the midst of a public health emergency.
During covid, Louisiana’s public health officer, Dr Joseph Kanter, inaccurately stated that EUA drugs and interventions are not experimental, when the law says otherwise. During the Edwards administration, the public was misled and misinformed repeatedly by those entrusted with the health and well-being of all Louisianans. This reckless disregard for the truth came at a tremendous cost as Americans were coerced and manipulated into undergoing medical experimentation without even a semblance of informed consent. Every attempt at increased uptake was a violation of human decency and human rights. Examples include the vaccine lottery, Shots for Santa, and enticements like free fries or donuts.
The most egregious were employee mandates on the part of the government which opened the floodgates for private employers to impose workplace mandates.
Why is it also necessary to provide a right to refuse for a countermeasure in addition to those medical interventions Authorized for Emergency Use?
Currently, there are declared countermeasures under the Public Readiness and Emergency Preparedness Act (PREP Act) that are NOT designated as EUA, but have the same liability protections. If individuals are harmed by medical interventions and have no means to be made whole, they should have the right to refuse those interventions, especially if those providing the product - the government, manufacturer, healthcare provider - are free from ALL civil liability.
With HB866, Rep Amedee intends to ensure that every Louisianan has the right to refuse any future encroachment on our civil and human rights by codifying this right with the necessary language to ensure that individuals are not discriminated against if they should refuse to undergo medical experimentation.
